1.1. These Terms and Conditions of Use (hereinafter “TCU”) govern the terms and conditions of access, navigation, and use of the Altimex website (and its subdomains, portals, and associated applications) (hereinafter the ‘Website’) by any person (hereinafter the “User”).
1.2. The Website is published by Altimex, a company offering consulting services, digital solutions, technologies, training, and digital support (hereinafter “Altimex” or “the Publisher”).
1.3. By accessing or using the Site, the User acknowledges having read these Terms of Use, accepts them without reservation, and agrees to comply with them in full.
1.4. Altimex reserves the right to modify these Terms of Use at any time. Modifications will take effect as soon as they are published on the Website. It is the User's responsibility to regularly consult the Terms of Use in force.
In these Terms of Use, the following terms shall have the following meanings:
User : any individual or legal entity accessing the Site, whether a customer or a simple visitor.
Services : the offers, tools, content, consulting services, training, support, software, modules, platforms, and multimedia content provided by Altimex via the Site.
Contents : all text, images, videos, files, data, interfaces, downloads, software, and trademarks presented or made available on the Site.
Compte utilisateur : personal space reserved for the User when they register to use certain Services on the Site (e.g. for training modules, customer platforms, etc.).
Login details : username, password, or any other means of authentication allowing access to a user account.
The purpose of the Terms of Use is to define:
the conditions of access to the Site and Services;
the rights and obligations of Users;
the respective responsibilities of the Publisher and the User;
the terms and conditions governing intellectual property, data management, limitation of liability, and dispute resolution.
4.1. The Site is accessible 24 hours a day, 7 days a week, except in the event of interruption for maintenance, updates, force majeure, or any event beyond the Publisher's control.
4.2. Altimex strives to maintain a good level of service and availability, but is only bound by an obligation of means.
4.3. Altimex reserves the right to temporarily or permanently suspend access to the Site or certain Services, in particular for maintenance or updates, without prior notice or compensation.
5.1. Certain Services require the creation of a user account. To register, the User must provide accurate, up-to-date, and complete information.
5.2. The User is responsible for maintaining the confidentiality of their login details (username, password, etc.) and for any activity carried out via their account.
5.3. In the event of unauthorized use or suspicion of compromise of their login details, Users must immediately notify Altimex so that measures can be taken.
5.4. Altimex reserves the right to suspend or delete a user account in the event of a breach of the Terms of Use, without prejudice to any other remedies.
6.1. The User agrees to use the Site and Services in compliance with applicable laws and regulations, public decency, and the rights of third parties.
6.2. In particular, it is prohibited to:
distribute, transmit, or post illegal, abusive, discriminatory, pornographic, defamatory, or hateful content;
impersonate a third party or infringe upon their rights;
send spam, viruses, or any files that may harm the integrity of the Site;
alter, disrupt, or attempt to enter the computer systems of Altimex or a third party;
reproduce, copy, modify, distribute, or republish the Site Content without prior written permission from Altimex (unless otherwise specified);
reverse engineer, decompile, or disassemble the software provided, unless otherwise permitted by law.
6.3. Altimex may make available Services under license, applications, or modules requiring additional terms of use (e.g., software licenses, access terms). The User agrees to comply with these additional terms.
7.1. All intellectual property rights relating to the Website, Services, Content, trademarks, logos, designs, models, and databases are the property of Altimex or its partners.
7.2. No ownership rights are transferred to the User, unless expressly stated otherwise.
7.3. For personal, non-commercial, and limited use, the User may view, download, or print the available Content, in compliance with copyright laws.
7.4. Any reproduction, representation, adaptation, translation, modification, total or partial exploitation, in any form whatsoever, is prohibited without the prior written authorization of Altimex, except as provided for by applicable law.
8.1. Altimex collects and processes personal data in the course of its activities and the provision of Services.
8.2. Altimex's privacy policy (accessible [link to Privacy Policy]) supplements these Terms of Use and informs the User about the methods of collection, use, sharing, security, and storage of personal data.
8.3. The User has the rights of access, rectification, deletion, opposition, portability, and limitation, in accordance with applicable data protection legislation.
8.4. The User is informed that the provision of certain data is necessary to access certain Services; in case of refusal, access may be compromised.
9.1. The Site, Services, and Content are provided “as is.” in its present state » and « according to availability ». Altimex does not guarantee that they will be free of errors, viruses, bugs, or that they will meet all of the User's needs.
9.2. Altimex shall not be held liable for any indirect damages (loss of data, commercial damage, damage to reputation, operating losses, etc.).
9.3. Altimex's liability, in the event of proven fault, is limited to the amount of fees or sums paid by the User to Altimex for access to the Service concerned during the 12 months preceding the damaging event, unless otherwise required by law.
9.4. Altimex accepts no responsibility for third-party websites to which the User is redirected via hypertext links, or for the content or services of such third parties.
10.1. The Website may include links to third-party websites. Altimex has no control over their content and cannot be held liable for any damage or harm resulting from their consultation.
10.2. The User may not create a hypertext link to the Site (in particular a deep link or framing) without the prior written consent of Altimex.
11.1. In the event of a breach by the User of any of the obligations set out in the Terms of Use, Altimex reserves the right to suspend or terminate the User's access to the Site or to certain Services, without notice, without compensation, and without prejudice to any damages that may be claimed.
11.2. In the event of termination, access rights shall cease immediately, without giving rise to any right to reimbursement or compensation.
11.3. The provisions of the articles relating to intellectual property, data protection, liability, duration, applicable law, and dispute resolution shall continue to apply even after access has ended.
Altimex reserves the right to modify, interrupt, or suspend, at any time and without notice, all or part of the Services, tools, features, or access to the Site, including technical changes, updates, and upgrades. Altimex shall not be liable to the User or any third party for any modifications, suspensions, or interruptions to the Service.
Altimex shall not be held liable for any failure or delay in the performance of its obligations resulting from a force majeure event (natural disasters, war, strikes, government actions, network failure, cyberattacks, etc.) preventing the normal operation of the Site or access to the Services.
14.1. These Terms of Use are governed by the laws applicable in Canada.
14.2. In the event of a dispute or claim relating to the interpretation or execution of the Terms of Use, the parties shall endeavor to settle their dispute amicably.
14.3. In the absence of an amicable agreement, the competent courts of Canada shall have sole jurisdiction, unless otherwise provided by mandatory law.
15.1. If any provision of the Terms of Use is found to be invalid, illegal, or unenforceable, such invalidity shall not affect the other provisions, which shall remain in full force and effect.
15.2. Altimex's failure to invoke a breach of the Terms of Use by the User at a given time shall not be interpreted as a waiver of the right to invoke said breach at a later date.
15.3. The User may not assign or transfer their rights and obligations under the Terms of Use to a third party without the prior written consent of Altimex.
